Senate Democrats Advance Legislation To Improve Criminal Evidence Sharing, Alleviate Judges’ Workload


SB 202 would define how evidence and information can be shared between defendants and prosecutors in misdemeanor cases

SB 327 would add a sixth judge seat to the Clayton Judicial Circuit to help alleviate the casework backlog

Atlanta, Ga. — Senate Bills 202 and 327, respectively led by Minority Leader Harold Jones II (D-Augusta) and Caucus Chair Elena Parent (D-Atlanta), advanced out of the Senate Judiciary Committee.


“SB 202 levels the playing field in misdemeanor cases by ensuring both the defense and prosecution share all available information. This bill helps both sides make more informed decisions and better serve their clients and the community,” Minority Leader Harold Jones II said. “SB 202 simply brings greater clarity and uniformity to the criminal process. By setting clear expectations for information sharing, we can reduce delays, strengthen due process, and promote fairer resolutions for Georgians.”


“The Clayton Judicial Circuit has the highest case workload in the state and its backlog endangers communities, delays justice, and wastes taxpayers’ money,” Caucus Chair Elena Parent said. “SB 327 remedies that problem by adding another superior court judge to help clear out the logjam. Providing Clayton County residents justice in a timely manner protects their rights to a speedy trial and promotes public safety.”

  • Change provisions relating to discovery in misdemeanor cases, allowing defendants to opt into reciprocal discovery similar to provisions in felony cases.

  • Require defendants to provide prosecuting attorneys with a list of witness and alibi information.
